"The Big Bang Theory" star's ex seeks spousal support

Many Texas readers are fans of the hit television show "The Big Bang Theory." One of the actresses on that show, Kaley Cuoco, was recently named one of television's highest paid performers. Cuoco is once again in the headlines, this time due to a court case in which her estranged husband is asking for spousal support from the star.

Cuoco married tennis pro Ryan Sweeting in late 2013, after just a few months of dating. The couple had a prenuptial agreement in place when they walked down the aisle in a wedding that was said to resemble a fairy tale. That fact, however, has not stopped Sweeting from asking for spousal support now that the union has failed. Sweeting is worth an estimated $2 million, which is impressive until one considers that his wife has an estimated net worth of $45 million.

The difference in income may be part of the motivation in seeking spousal support. However, Sweeting will be fighting an uphill battle, due to the fact that he signed a prenup prior to marriage. Unless he can prove that he was misled about Cuoco's financial standing or signed the document under duress, the court is likely to uphold the prenuptial agreement.

For those in Texas who are considering drafting their own prenup to determine the division of assets or outline spousal support obligations, it is important to take precautions that will ensure that the document can withstand a legal challenge. One such step is to ensure that plenty of time is given for both parties to review the document and obtain legal counsel on the matter, all prior to the wedding date. Another is to go through a comprehensive financial disclosure, in which all assets are listed. These two steps will be sufficient to protect the vast majority of prenuptial agreements from legal challenge.
